Under this legislation the overwhelming majority of companies in the United Kingdom are subject to scrutiny by the police and the Health and Safety Executive in the event of a workplace death. The act introduced the new offence of corporate manslaughter and if convicted a company may face an unlimited fine. The act also makes provision for the prosecution of individual directors.
Dealing with claims of unfair dismissal is in the hands of the Employment Tribunal Service they are empowered to handle in excess of 70 different types of complaint including those of unfair dismissal on the grounds of race, sex, age and disability discrimination, plus complaints in respect of breach of contract and redundancy issues.
Under an employment tribunal service investigation the company will incur significant cost and indeed it is not possible for directors to face claims for compensation made directly against them.
